Kolfund Terms of Service

Effective Date: March 26, 2025

1. Introduction Welcome to Kolfund (“we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Kolfund mobile application (the “App”) and related services. By downloading, installing, or using the App, you agree to these Terms.

3. Eligibility You must be at least 18 years old and capable of forming a binding contract under Singapore law to use the App.

4. Account Registration Users must create an account to access certain features. You agree to provide accurate information and keep it up‑to‑date.

5. Content Creation and Submission You agree to create content using any product or service provided through the App and submit it by the agreed deadline.

6. Adherence to Content Guidelines You agree to follow all guidelines provided by Kolfund or its brand partners and include all required elements in your content.

7. Content Posting and Proof of Work Creators are not required to submit a draft for approval prior to publishing. Instead, you agree to post the agreed content (e.g., Instagram or TikTok Stories, feed posts) directly to your social media account by the campaign deadline and upload proof of publication (e.g., screenshots, links) through the App. Once proof is uploaded, the relevant brand will be notified automatically.

8. Timely Submission, Extensions & Liability You must upload proof of your published content by the campaign deadline. If you require more time, you must request an extension through the App before the original deadline. The brand must approve any extension request; failure to obtain approval or to submit proof by the final deadline will render you liable to pay the full retail price of the provided product as listed at the brand’s official pricing.

9. Content Usage Rights By submitting content through the App, you grant Kolfund Pte. Ltd. a perpetual, worldwide, royalty-free, sublicensable license to use, reproduce, distribute, display, and modify your content for Kolfund’s marketing and promotional purposes.

Brands and campaign partners may repost your content in its original form only. Any download, editing, modification, or use beyond reposting — including repurposing for advertisements — is strictly prohibited unless the brand obtains a separate usage license directly from you.

Kolfund acts as intermediary to facilitate negotiation of any additional usage rights. Such extended usage rights are subject to a mutually agreed fee between you (the creator) and the brand for each campaign, with Kolfund coordinating the agreement and fee collection on behalf of both parties.

10. Communication in Case of Issues If you encounter any issues, delays, or are unable to complete a campaign, you must first notify the relevant brand contact directly through the App or via any contact details provided. If the issue cannot be resolved with the brand within a reasonable timeframe, you may then escalate the matter to Kolfund by emailing contact@kolfund.com or submitting a support ticket through the App. Kolfund will assist in mediating and finding a resolution on behalf of both parties.

11. Intellectual Property All trademarks, logos, and content provided through the App remain the property of their respective owners. You retain ownership of your user‑generated content but grant usage rights as described above.

12. Prohibited Conduct You agree not to misuse the App, including but not limited to posting unlawful, defamatory, or infringing content, or interfering with others’ use of the App.

13. Termination Kolfund may suspend or terminate your account for breach of these Terms, at our sole discretion, without prior notice.

14. Disclaimers and Limitation of Liability The App is provided “as is.” To the maximum extent permitted by law, Kolfund disclaims all warranties. We shall not be liable for indirect, incidental, or consequential damages arising from your use of the App.

15. Governing Law and Dispute Resolution These Terms are governed by Singapore law. Any dispute shall be resolved exclusively in Singapore courts.

16. Amendments We may update these Terms at any time. We will notify you via the App or email, and your continued use constitutes acceptance of the changes.
